On July 15, 2026, the leadership of the House Energy and Commerce Committee announced the first congressional hearing on the Nitrous Oxide Safety Act of 2026 (H.R. 7945), scheduled for July 22 before the Subcommittee on Commerce, Manufacturing, and Trade. A committee memorandum released on July 20 adds the detail suppliers have been waiting for: the bill would prohibit any consumer product containing nitrous oxide under section 8 of the Consumer Product Safety Act, and the text names its exceptions explicitly — medical and dental treatment, commercial production of food or food products, and research and development. For cream charger suppliers, the carve-out that matters most is now on paper.
The committee memo describes the bill's structure in one sentence: a prohibition on any consumer product that contains nitrous oxide, enforced through the Consumer Product Safety Act. Routing the ban through the CPSC places N2O alongside other hazardous consumer products rather than inside drug-control law, and it puts packaging, labeling, and retail conduct under product-safety enforcement. The memo lists three exceptions:
The bill is sponsored by Reps. Kevin Mullin and Stephanie Bice, giving it bipartisan authorship in a committee that moved it to hearing within weeks of introduction — an unusually fast track for product-safety legislation.
The direct answer for cafés, restaurant groups, and distributors: if H.R. 7945 becomes law as written, buying food-grade N2O for culinary production remains legal at the federal level, because the exemption covers the commercial production of food itself, not a narrow list of approved products. The consumer shelf is what closes. Large flavored tanks sold through vape shops, convenience stores, and online marketplaces lose their legal channel; documented B2B supply for kitchens keeps operating.
This mirrors the design already running at state level. Tennessee's retail ban, New South Wales' November rules, and the UK's 2023 framework all shut the consumer door while preserving food-service trade. A federal CPSC route would standardize that split across all fifty states instead of leaving it to patchwork state law.
The hearing begins at 10:15 a.m. Eastern in 2123 Rayburn House Office Building, as part of a broader session on consumer-protection legislation. A subcommittee hearing is the first formal test of a bill: witness testimony, member questions, and the first public signal of whether leadership intends a markup. Two developments around it are worth tracking. First, the Senate side — Senators Wyden, Blumenthal, and Padilla introduced a companion-track bill on July 15 that regulates marketing, flavors, and labeling through the FDA, so both chambers now have moving vehicles. Second, any amendment language touching the food-production exception. Buyers with US exposure should read the hearing record when published, and suppliers serving the American market should already be running the documentation discipline both bills assume: food-grade certification, batch traceability, and verified business purchasers. Champion Whip ships food-grade N2O chargers and cylinders with E942 documentation and batch tracking as standard, and our wholesale program runs purchaser verification for exactly this regulatory environment. Background on the bill itself is in our earlier report on the Nitrous Oxide Safety Act and its food-grade exemption.
