A bill moving through the US Congress would ban retail sales of nitrous oxide to consumers nationwide, including online sales. The bill keeps legitimate food production, medical, dental, industrial, and automotive use legal, so licensed food-service supply is not the target. What the Nitrous Oxide Safety Act Would Do

H.R. 7945 would classify any consumer product that contains nitrous oxide as a "banned hazardous product" under Section 8 of the Consumer Product Safety Act. If it passes, the ban takes effect 180 days after enactment. The bill was introduced by Rep. Mullin (CA-15), co-sponsored by Rep. Stephanie Bice (R-OK), and referred to the House Committee on Energy and Commerce in March 2026.

  • Retail and online sales of N2O to consumers would be prohibited, even when the product is labeled "food use only" or carries a warning label.
  • Legitimate uses stay legal: medical, dental, food production, industrial, automotive, and research.

Is this a law now? No. As of mid-2026 the bill sits in committee. It has bipartisan backing but has not passed the House or Senate, and no federal ban is in force yet.

The bill preserves food-production and commercial use, so B2B food-service supply is not banned under the current text. The change is in who has to prove what.
