On September 16, 2026, the House Committee on Energy and Commerce voted 36-0 to advance H.R. 7945, the Nitrous Oxide Safety Act of 2026, sending the bill to a full vote on the House floor. The measure would end retail sales of nitrous oxide to consumers nationwide, while written exemptions preserve access for medical, dental, industrial, research, automotive, and food production channels. For foodservice operators and their suppliers, the load-bearing fact is this: commercial kitchens are named in the bill text as a protected use.
The bill is three pages long and works through consumer product law. One hundred eighty days after enactment, any consumer product containing nitrous oxide becomes a banned hazardous product under section 8 of the Consumer Product Safety Act. From that point, it would be unlawful to sell, offer for sale, manufacture for sale, distribute in commerce, or import such products in the United States.
The statute targets commerce, not possession. Owning or using nitrous oxide does not become an offense; the pressure point is every legal sales channel that currently moves the gas to retail buyers. The exemptions are written with unusual precision:

One obligation lands on the supply side: anyone selling nitrous oxide for a legitimate use must be able to show the product is not reaching consumers, or face civil or criminal penalties. The committee advanced the bill without amendments, so the text that passed markup is the text as introduced by Rep. Kevin Mullin (D-CA) in March.
The committee vote followed a September advocacy push by People Against Nitrous Oxide (PANOS), a coalition of parents whose children were injured or died after inhaling nitrous oxide sold as a recreational drug. More than 40 parents lobbied Capitol Hill in early September, and the bill has gained 19 bipartisan cosponsors since their visit. Public health data cited by the sponsor estimates that more than 14 million Americans have misused nitrous oxide in their lifetime, with deaths linked to misuse up an estimated 578% over the past decade. Several states have already enacted their own retail restrictions; H.R. 7945 is the first federal proposal to reach a floor vote.
