On July 15, 2026, the leadership of the House Energy and Commerce Committee announced the first congressional hearing on the Nitrous Oxide Safety Act of 2026 (H.R. 7945), scheduled for July 22 before the Subcommittee on Commerce, Manufacturing, and Trade. A committee memorandum released on July 20 adds the detail suppliers have been waiting for: the bill would prohibit any consumer product containing nitrous oxide under section 8 of the Consumer Product Safety Act, and the text names its exceptions explicitly — medical and dental treatment, commercial production of food or food products, and research and development. How the Ban Mechanism Works

The committee memo describes the bill's structure in one sentence: a prohibition on any consumer product that contains nitrous oxide, enforced through the Consumer Product Safety Act. Routing the ban through the CPSC places N2O alongside other hazardous consumer products rather than inside drug-control law, and it puts packaging, labeling, and retail conduct under product-safety enforcement. The memo lists three exceptions:

  • Medical and dental treatment. Clinical analgesia and sedation use continues untouched.
  • Commercial production of food or food products. This clause covers the culinary supply chain — chargers and cylinders sold for whipping cream, foams, and beverage programs.
  • Research and development. Laboratory and technical applications stay legal.

Why the Food Production Carve-Out Matters

The direct answer for cafés, restaurant groups, and distributors: if H.R. 7945 becomes law as written, buying food-grade N2O for culinary production remains legal at the federal level, because the exemption covers the commercial production of food itself, not a narrow list of approved products. The consumer shelf is what closes.
